Welcome to Elevor (“we,” “our,” or “us”).
Elevor provides an AI-powered content platform that analyzes brand materials and automatically generates, manages, and publishes written content consistent with your brand’s tone and style (the “Service”).
By accessing or using the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (the “Terms”).
If you do not agree to these Terms, you may not use the Service.
You must be at least 18 years old and capable of entering into a binding contract to use Elevor.
If you are using the Service on behalf of a company or organization (your “Company”), you represent that you have the authority to bind that entity to these Terms. In that case, “you” and “your” will refer to that entity.
Elevor provides the following functionality:
We may modify, suspend, or discontinue any part of the Service at any time.
We will use reasonable efforts to provide advance notice of any material changes that may adversely affect you.
You are responsible for:
You agree not to use Elevor to generate or distribute illegal, infringing, defamatory, or harmful content, including but not limited to misinformation, hate speech, or copyrighted material you do not own.
All intellectual property rights in and to the Service, including software, algorithms, AI models, and platform technology (excluding Your Content and Generated Content), are and shall remain the exclusive property of Elevor and its licensors.
“You retain all right, title, and interest in and to (a) Your Content and (b) any AI-generated outputs created by the Service based on Your Content or your input instructions (“Generated Content”).”
Definition:
“Generated Content” means any output text, data, or material generated by the Service as a result of your use.
You grant Elevor a limited, non-exclusive, non-transferable license to use, process, and store Your Content solely as necessary to operate, maintain, and provide the Service to you.
Elevor will not access, use, or disclose Your Content except as necessary to deliver the Service or as required by law.
This license does not grant Elevor any right to use Your Content or Generated Content to train, fine-tune, or improve general-purpose AI models or any models intended for other customers.
If the Service is offered on a paid plan, fees and billing terms will be presented during checkout or in a separate written agreement.
You may request a full refund within fifteen (15) days of your initial payment for any subscription plan, provided that you have not materially violated these Terms and that your use of the Service during that period has been in good faith.
After this 15-day period, all payments are non-refundable unless required by law.
Subscription fees are final for each billing term, and no refunds will be provided for partial use or early cancellation beyond the initial 15-day refund window.
We may suspend or terminate your access to the Service if payment is overdue or if you materially breach these Terms.
Your Content and Generated Content are treated as your confidential information.
We will not share or disclose them except (a) as required to provide the Service (e.g., integrations with your CMS) or (b) as required by law.
Elevor does not use Your Content or Generated Content to train, improve, or fine-tune its general AI models or any models used for other customers.
Your data is processed exclusively to provide and support the Service you request.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
Elevor makes no representation or warranty that:
AI-generated materials may contain factual inaccuracies or third-party copyrighted elements.
You are solely responsible for reviewing, editing, and approving all Generated Content prior to publication.
You assume all risks associated with your publication or use of such content, including claims relating to accuracy, defamation, or intellectual property infringement.
To the maximum extent permitted by law, Elevor and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of or inability to use the Service.
In no event shall Elevor’s total aggregate liability for all claims exceed the total amount of fees paid by you to Elevor during the twelve (12) months preceding the event giving rise to the claim.
The foregoing limitations shall not apply to damages resulting from Elevor’s gross negligence, willful misconduct, or violation of applicable data protection laws.
You may stop using the Service at any time by canceling your account.
We may suspend or terminate your account if you breach these Terms, misuse the Service, or use it in a way that could cause harm to others or to Elevor.
Upon termination, your rights under these Terms will cease immediately, but the following sections shall survive: 5 (Intellectual Property), 7 (Confidentiality), 8 (Disclaimers), 9 (Limitation of Liability), and 11 (Governing Law and Arbitration).
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Cheyenne, Wyoming, rather than in court.
The arbitration shall be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules then in effect.
The arbitrator’s decision shall be final, binding, and non-appealable.
Each party shall bear its own costs and attorney’s fees unless otherwise required by law or determined by the arbitrator.
You and Elevor agree to waive any right to a jury trial and agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
